All intellectual property rights in this Platform and all materials related to or appearing on it (including any content submitted or posted by Saydak and all content uploaded to the Platform by Saydak) are owned by Saydak, and Saydak may dispose of such property as it pleases. You must not reproduce or permit anyone, for any reason, to use or reproduce the Services or any trademarks or other trade names appearing on the Services.
Legal Responsibility
The information, recommendations, services or any of them provided to you on or through the Website, Service and Platform are for general information purposes only and do not constitute any advice. Saydak will keep the Website, Platform and its contents as accurate and up-to-date as possible, but does not guarantee that the (contents) of the Website or Platform are free from errors, defects, malware and viruses, nor does it guarantee the accuracy, correctness and up-to-dateness of the Website and Platform.
Saydak shall not be liable for any damages resulting from the use of (or inability to use) the Website or Platform, including damages caused by malware or viruses, nor shall it be liable for the incorrectness or incompleteness of the information or the Website or Platform, unless such damage is the result of willful misconduct or gross negligence on the part of Saydak.
The responsibility for the quality of the services requested using the Platform or Service lies entirely with the fisherman who ultimately provides the service to you. Under no circumstances shall Saydak accept any liability in connection with or arising from the services provided by fisherman, nor shall it accept liability for any acts, conduct, behaviour or negligence, or all of the above, on the part of fisherman and therefore any complaints regarding the services should be submitted on fisherman.
Limitation of Liability
Saydak makes no warranties, express or implied, relating to the Services, all of which are provided at the responsibility of the fisherman. Saydak expressly disclaims, to the fullest extent possible under the law, all warranties, including but not limited to, warranties of fitness for a particular purpose, fitness for particular specifications and markets, and merchantability, and Saydak does not guarantee the accuracy, content, or timeliness of the Services or the results
that may or may not be obtained by the user of the Services. In no event shall Saydak, its agents, licensors, or affiliates be liable for any direct, indirect, punitive, special, incidental, or consequential damages (including, but not limited to, damages resulting from loss of profits, business interruption, loss of business information, or other financial loss) resulting directly or indirectly from access to, use of (or failure to use) or reliance on the Services. Any offers, advertisements or contests that are not announced on the official Saydak website or via social media affiliated with Saydak and managed by Saydak are not valid and you are not entitled to ask Saydak to implement them. In addition, Saydak is not responsible for any fraudulent act committed through offers, advertisements or contests held unofficially in the name of Saydak.
Security
You acknowledge that you are solely responsible for the privacy of the Services, and you are solely responsible for their use by any other person using your account and/or username, password or access credentials. You also agree to notify Saydak if you become aware of any loss, theft or unauthorized use of any password, username, IP address, or other means of accessing the Services
Dealing with others
While using the Website, Platform and Service, links may be provided from time to time to websites owned and controlled by third parties for you to correspond with, purchase products or services from, or participate in promotions offered by third parties. These links take you outside the Website, Platform and Service and are outside of Saydak’s control. While using the Website, Platform and Service, you may correspond with, purchase goods or services from, or participate in promotions offered by service providers, advertisers or sponsors who offer their goods or services via a link on the Website or through the Platform or Service. These links take you outside of the Website, Platform and Service and are outside of Saydak’s control. The websites you may link to have their own terms and conditions and privacy policies. Saydak is not responsible for, and cannot be held liable for, the content or activities of such websites. Therefore, you bear the entire risk of visiting or accessing such websites. Please note that these other sites may send their own cookies to users, collect their data or request personal information, so we recommend that you check the terms of use or privacy policies on those sites before using them.
Modification of the Service and User Terms
Saydak reserves the right, in its sole discretion, to modify or replace any of these Terms of Use, or change, suspend or discontinue the Service or Platform (including without limitation, the provision of any feature, database or content) at any time by posting a notice on the Site or by sending you notice through the Service or Platform or by email. Saydak may also impose limits on certain features and services or block your access to parts or all of the Service without notice or liability.
- Quality of products and services
Undoubtedly, fishermen are the first link in the chain of trading marine products, and here lies the role of Saydak as a link between you and the fishermen. The application is also keen to oblige fishermen to publish comprehensive photos and write a clear detailed description of the exhibits provided. Saydak also allows its customers to communicate with the fisherman to know all the details of the exhibits, in addition to enabling the customer to evaluate the fisherman and view the evaluation record of other customers. Without Saydak interfering or bearing responsibility for ensuring the quality of the product and services provided. - Pricing
Saydak encourages the fisherman to offer competitive prices to support the spirit of competition among them without interfering in the pricing process. - Packaging
– The responsibility for packaging lies solely with the fisherman Saydak bears no responsibility in this regard.
– If a thermal box with ice is required, the service will be provided by the fisherman for an additional fee. - Cleaning
– Fish cleaning is an optional service provided by the fisherman to the customers at a suitable price determined by the fishermen. You can find out whether the service is available with a particular fisherman or not by reading the description included in the post by the fisherman.
– Make sure to choose the desired cleaning method (frying-grilling) and you can clarify the special cleaning specifications (if any) by contacting the fisherman.
– Saydak does not bear any responsibility regarding the cleaning process or its requirements. It also allows the customer to obtain a detailed evaluation through Saydak. - Delivery
– Delivery is made by the fisherman for a fee (determined by the fisherman).
– After arriving at the delivery location, if the customer does not respond or show up, the fisherman is obligated to wait for a maximum of 20 minutes, once the time of waiting is done the order will be cancelled. - Refusal to receive
– You have the right to refuse to receive the order in the event that: there is no match between the images and details included in the post.
– It is the customer’s responsibility to ensure that the order prepared for delivery is suitable in terms of (freshness, cleanliness, type, etc.) before receiving the order, so that in all cases the customer’s rejection of the order after receiving it will not be accepted.
– In case of refusal to receive the request, immediately contact Syadak customer service via email [info@syadak.com] and attach photos showing the reasons for the refusal. - Order Cancelation
Once payment is made, the order cannot be cancelled - Refund
Saydak will process your refund within two weeks if the rejection is deemed valid.
* ”Note” No refund will be given if the order is refused without a valid reason. - No response upon receipt
Saydak reserves the right not to refund the amount to the customer if the delivery representative arrives at the customer’s location, and upon attempting to contact the customer for a period of not less than 15 minutes from the time of arrival without receiving an answer or acknowledgment, the representative will leave without delivering the order. - Health problems
Saydak does not bear any responsibility for health problems arising from the consumption of products sold through Saydak. The responsibility lies entirely on the fisherman. - Governing law
The terms and disputes arising in connection with the use of the application are subject to the law of the Kingdom of Saudi Arabia. - Conflicts
Starting Viion will assist in resolving potential disputes with fishermen, but Starting Vision is not responsible for the consequences of such disputes between the fisherman and customers. - Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. - No concessions
Any failure or delay by your company to exercise any right under these Terms shall not constitute a waiver of such right. - To communicate

You represent and warrant that:
1. That your use of the services of the Saydak application has never been suspended or prevented from using it at any time.
2. That you are not a competitor to Saydak, nor do you offer any product that competes with the services provided by Saydak.
3. That you have full power and authority to agree to the agreement and that you will not be in violation of any law or contract, and that you do not have any judicial precedents, arrest warrants or claims from the security authorities
Undertakings and warranties
You represent and warrant that you will:
– Comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.
– Provide correct and accurate information to “Saydak” and update it periodically.
– Commit to accurately photograph the exhibits clearly to show their freshness, safety and conformity with what is actually delivered to customers.
– Review and comply with any notices sent through the “Saydak” application regarding your use of the provided service.
– You will not duplicate sublicenses, issue, publish, transfer, distribute, perform, display, sell, or reclassify “Saydak” services, otherwise you will have transferred the service or exploited it commercially, except as permitted under this contract.
– You will not use the information, content or any data through the “Saydak” services for any other purpose, and you will use the application and the service exclusively by yourself. You will not sell it to any third party.
– You will use the Application for lawful purposes only, and will not use the Services to send or store any illegal material.
– You are fully responsible for the quality of your items as well as the safety and quality of packaging, transportation and handling.
– You will not use the Service or Application to harm, harass, or inconvenience anyone.
– It will not impede the proper operation of the “Saydak” application.
– You will not attempt to harm the Service or the Application in any way.
– You will keep your account password, as well as any identification we provide to you that enables you to access your account, secure and confidential.
– You will provide us with all evidence of your identity at your “Saydak’s” sole discretion.
– “Saydak” has the right to refuse to provide the service or use the application without giving reasons.
– You will not use the information, content or any data you access or obtain through the “Saydak” services for the purpose of competing and selling marine products outside the scope of the application to “Saydak” customers.
– You acknowledge and agree to always be honest with regard to the quality, freshness and safety of the exhibits, and you agree that in the event of discovering any fraud, manipulation, deception or misrepresentation of the service to the customer that directly or indirectly harms the application, you will be subject to stopping your services and
blocking them from the “Saydak” application. You will also bear the damage incurred and compensate the customer, whether by deducting the full value of the publication or part of it or by demanding the necessary compensation before the competent authorities in the Kingdom of Saudi Arabia.
1. Registration and Account
– Register and create an account to publish your daily marine product offers and share transactions through the “Saydak” application.
– Maintain confidentiality and ensure that all account information provided is accurate and up-to-date.
2. .Listing and Pricing
– Make sure to provide as much detailed and accurate information as possible regarding the type, weight and size of the exhibits. Also, ensure that the images match what is delivered to the customer.
– You set a competitive and appropriate price for your products.
– There are currently no fees on the Platform, however, by agreeing to these Terms, you acknowledge and accept that Saydak reserves the right to charge fees on the Platform in the future. You agree to abide by and accept any fees that may be charged.
3. Payment and Commission
– In the event that the request is rejected by the customer, Saydak Customer Service is the party responsible for the evaluation process and deciding on the validity of the reasons for refusing to receive. The fisherman has the right to object and clarify his point of view by communicating via e-mail [info@saydak.com]
– For orders that are rejected by customers without valid reasons, you will receive the full amount of the payment, taking into account future platform fees, if any.
– If the customer refuses to receive the order due to inaccuracy in the type, weight or quality of the product, the order will be cancelled and the full amount will be returned to the customer.
5. Quality and Safety
– Ensuring that the fish listed is fresh, safe and complies with all local and national health regulations in the Kingdom of Saudi Arabia.
6. Marine Environment Safety
– You bear full responsibility for the extent to which your exhibits comply with the provisions of the Ministry of Environment and the General Authority for Fisheries Resources in terms of the type of prohibited marine organisms, prohibited fishing methods and means, as well as the annual fishing ban seasons for specific types of marine creatures.
7. Services provided
● Cleaning and cutting (optional service)
– It is considered an optional additional service provided by fisherman for a suitable fee (determined by fisherman) if requested by the customer. The service of cleaning, cutting and packaging the exhibits in a suitable manner is considered a basic supporter for the popularity of fisherman account and products by receiving excellent reviews and ratings.
● Delivery (mandatory service)
– Delivery of exhibits is a mandatory service provided by the fisherman to the customer.
– The customer’s location should be taken into consideration before accepting the order and a suitable delivery time should be set after reviewing the customer’s order to complete the process (time frame options will be indicated to enable you to clearly specify it during the transaction and will be shown directly to the customer)
– It is committed to adopting standards for maintaining the safety of products that are transported during delivery so that orders are delivered in a healthy condition.
– If you reach the customer and they do not respond, the waiting period is a maximum of 20 minutes. You then take a screenshot to prove this and contact customer service for review and verification. Then the customer is obligated to pay the full value of the order and services.
● Packaging (mandatory service)
– Providing a thermal box and an adequate amount of ice is a mandatory service provided by the fisherman for an appropriate fee (determined by the fisherman) if requested by the customer.
– Paying attention to the final appearance and the quality of packaging the exhibits in a proper manner is a basic support for the popularity of the fisherman account and its products by receiving positive reviews and ratings.
8. Pricing
– The fisherman is committed to setting appropriate prices for the exhibits in line with the prices of local markets.
– Saydak does not interfere in the pricing process of marine products and reserves the right to delete posts with illogical pricing and close the account.
– Maintaining the best offers and prices on Saydak is a major supporter of the popularity of the fisherman account and its products by receiving positive reviews and ratings.
9. Delete
– Saydak reserves the right to delete any posting if it is deemed inaccurate or misleading or if the posted products do not meet the required quality standards
– Saydak reserves the right to cancel your account and prevent you from accessing the application services in the event that you violate any of the terms of this (Agreement). In this case, Saydak shall not bear responsibility for any financial transactions pending the moment the account is closed.
10. Conflicts
– Starting Viion will assist in resolving potential disputes with customers, but Starting Vision is not responsible for the consequences of such disputes between the fisherman and customers.
11. Modification and exclusion
– We reserve the right to modify these terms or terminate the application at any time without prior notice. Continued use of the “Saydak” application means acceptance of the modified and exclusionary terms.
12. Governing law
– The terms and disputes arising in connection with the use of the application are subject to the law of the Kingdom of Saudi Arabia.
13. Severability
– If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
